A UFT SOLIDARITY LEADER SUES DOE TO GET REMOTE TEACHING FOR JANUARY 3-18 DUE TO UNSAFE CONDITIONS

UFT Solidarity and United for Change Executive Board candidate Lydia Howrilka is not waiting around to see what the UFT does with the omicron surge now up to close to half a million US cases in one day on Wednesday. Lydia was in Manhattan today filing an Article 78 court case against the City-Department of Education to get remote teaching from January 3, 2022 through January 18, 2022.

Here is the Order to Show Cause she is asking the judge to sign:

  2. At least someone is doing something though it may be a fruitless endeavor. It says in the contract that we don't have to report to work if we feel the conditions are unsafe.

  4. I’m sorry but I’m very confused here. Why have so many people lost faith in being vaccinated and boosted? We are protected so we should show up to work. It’s that simple.

    1. We are not protected. We can still get sick. Some folks will get really sick. Many known underlying conditions for teachers and they refuse to give medical exemption . The same exemption that was given before the vaccine was developed. We now know many are still getting sick with the vaccine and booster. Shame on us as a people wanting humans to die ! When you know better you should do better. The long term effects from COVID-19 are too many to name.

    4. Vaccinated and boosted doesn’t mean we can’t transmit the virus and contribute to a possibly more deadly variant. This virus must be eradicated before things will ever get back to normal. That can’t be done if we continuously engage in mini-super spreader events, i.e. Schools where social distancing does not take place and people don’t properly wear their masks. The greater the spread, the greater the chance for a nasty more deadly vaccine resistant variant to evolve.

    Fauci says many kids are actually hospitalized “with” Covid, not “from” Covid, so child Covid hospitalization numbers are inflated.

    1. So the memo says per calendar year. Event resets tomorrow. For symptoms you get 10 days, if you test positive, 2 weeks with the ability to get 2 additional if needed.

    UPDATE: For students in 3-K and Pre-K, the quarantine policy will remain the same, meaning that any 3-K or Pre-K student who was in close proximity to a positive case will still have to quarantine for 10 days. No test kits should be given to 3K and Pre-K students until further guidance.

    So the DOE is going to continue to not test these students and pretend it's safe for them to be in school? They eat breakfast, lunch and snack and nap all without wearing a mask. Very difficult to keep them 3 feet apart all the time. What further guidance? Should be a plan to protect these students and teachers now!

  17. At least 10 school districts in Hudson County, Nj—switching to remote for at least a week. Will NYC schools decide likewise—especially with too much uncertainty with the lack of adequate testing—Mulgrew speak up and much louder, please.

    Stress, the processed food, lack of taking long walks regularly will.

    Yes COVID is way up all around us. UFT friends all ready got hit a few early in week and as the weekend approaches.

    Symptomatic, first neg before time with family not from household...then positive. Was family emergency so had to take mom and baby in in one case. I gave tests but then. More felt sick..day later after the neg test. It happens don't be angry with anyone.

    So you are right to be afraid. After 2yrs suddenly leaders suddenly are saying forget it we have done all we can. Booster useless, trust your T cells.

    That was always likely...Hence why FDA only wanted for elderly or compromised. It is hard for me and I already agreed with FDA staff that resigned.


    We are in this together, we will be ok. We were ok before vax, Sept sent in no masks supplied, no HEPA, no testing, junk thermometer.

    Remember the folly of checking temp and wiping desks for respiratory virus.

    I'm cool with going in Mon with only those feeling sick to stay home.

    Testing can't help since too many kids and staff will overwhelm.

    Too late, should have had a plan before any new variant hype Thanksgiving.

    Mayor Adams is only hope. Get on social really try to convince parents and staff to stay home if feeling sick. If people around you at party where you were for 30min plus feeling sick. Stay home 2-3days and then re assess.

    Vast majority do not have COVID and don't have symptoms so coming in wouldn't affect us.

    Parents are tough to deal with sending in sick and exposed kids.

    Staff also still have habit denying their running nose and headache we see them treating.

    We are adults, we have relationships with colleagues. We can work to a consensus amongst ourselves to cover for the sick. Heck isolate in our own classroom if they already came in.

    Walmart+ has free trial. Binax now tests pop up randomly as available for $14 free ship to arrive Tues. I got 6 more kits least week, 3 more order this morning. Arrived day early FedEx.

    This will allow me to keep offering to family and colleagues that feel sick.

    Hopefully I can get reimbursement but I'd rather lose the $ then need to run around when I feel sick or get sick since people can't get tested and then be around me.

    I've had S4 cancer and care for dementia mom in home so I am not risk free but I will continue to go in.

    Bring in your own HEPA Winex from Costco $100, eat right, keep windows open, get tests from Amazon Walmart to have one handy if you feel sick.

    James, what is courageous about someone who has lost faith in being vaccinated and boosted? I have Omicron for a couple days. I can tell you all right now, I’ve gone to work several times feeling way worse than this. You all are literally afraid of cold-like symptoms.

    1. 9:20 & 8:18 if u all get my teen who is high risk fatality due to underlying conditions & my teen brings it back to me & I've got MULTIPLE SEVERE underlying conditions..both of us are immunocompromised due to meds we take daily.. I'll find out who u are AND not only sue DOE & UFT & CITY OF NY & STATE OF NY & ALL STATE OFFICIALS ...but YOU BOTH WILL ALSO BE FOUND OUT & SUED DIRECTLY ALONG W/THE REST!   24. They sent letters to retired teachers asking them to become a substitute since they anticipate lots of absences in January. 200 a day plus a 50 bonus for 250 a day. Wow!

  25. Uft members are lambs. Our union has failed us .Mulgrew is sinking us on his way to a pension he earned on our backs.

    DiBlasio gave his wife a billion dollars that’s unaccounted for . He uses NYPD for his presidential security force when he made his joke of a run.

    And you are standing strong and do not want remote for a few weeks ?
    The NHL has paused , look at all other industries!! Why do you want to baby sit in a Petri dish?

    Students in my school do not change classes . Woodshop , dance studio and gym are not used. Many classrooms are 1/3 the size of these rooms . There is zero distancing and student take masks off constantly.

    Classroom was closed in October. I was in the room 3 times the week prior and I was not notified. A fully vaxed staff member got this virus was in coma / and rehab and returned to work 2 days before the Christmas break.

    Open your eyes , this is not educating students this is warehousing them .

So our vacation time wasted again(spring break) to be tested to so that we can enter these terrible school buildings to get covid again?

  29. Regarding subs - not to mention, it's no better than remote instruction, in fact it's far worse. Sub teachers teach absolutely nothing and let the kids run amok. It's not their fault, they haven't established protocols in the class, or had a chance to establish norms. What a failure of a system we work in.

    Smarten you please. I am sure you have a masters plus 30 . Uft is not really a Union. Our chapter leaders are rated by the Administration they stand up to. Only so much they can actually accomplish.

    Carpenters and local 3 electrician reps are paid by the union not the employer. See the difference?

    Unless you are Mulgrew I can not believe that you think he is a strong leader.
