UPDATES FROM UFT SOLIDARITY ON COURT CASE AND ONLINE MEETING SUNDAY

From UFT Solidarity leader Lydia Howrilka:

Injunction News: Recently there have been a ton of people emailing Lydia Howrilka and Bryan Glass to see if they can get in on the suit. We are filing the petition but we can add additional facts and plaintiffs to an Amended Petition that we can submit afterward.

If you were denied an accommodation or are unable to receive one because you don't qualify, you might want to join.

If you want to join the fun, email Bryan Glass at bglass@ghnylaw.com

He will be charging $500 per petitioner to cover with the filing fee and the long hours editing the Amended Petition and other legal documents.

UFT Solidarity will be holding an emergency meeting on Sunday, September 6, 2020 at 2:00 P.M. on Google Meet.

James...

I was granted a medical accomdation; do I need to show up for training, the days before the students show up?

James Eterno said...

No, you work remotely.

You had me til $500. Imagine if we had a real union that would do this for us with all the money we give them. Embarrassing.

I'm embarrassed that all of you still pay dues. They can abuse me without taking my money.

What does everyone think will happen when the buildings are still not ready on the 21st? Who’s gonna make a stand? - Hawk

$500 retainer is nothing. Bryan Glass is the real deal, doesn't grandstand, and only takes cases he thinks he can win.

safety reports literally say teachers must return to buildings even if they’re NOT READY/SAFE!!! Building will only close if they are still not safe by the time students enter...
@MOREcaucusUFT
this is how our union “fights for us”... Mulgrew’s a traitor!

Is this true???? We can have a class action lawsuit. Definitely need a vote of no confidence

Chapter leader told me the report states that the only thing needed by Sept 8th is just masks, and teachers can report. Everything else needs to be completed by Sept 21st. My building still doesn’t have MERV13 filters, but we are told by
@UFT
and the superintendent we must go in.

Yeah, our CL shared it to us and it is widely known that we don’t have the filters yet... superintendent still wants us to go in. And it’s the same with schools my friends work at (I’ve seen their reports also... sane problems).

I'm no showing.

City schools are still 150 nurses short of fulfilling Mayor de Blasio’s promise to put one in every building before classes begin in two weeks, the Post has learned.

The city has hired 250 nurses as of Thursday, in hopes of fulfilling de Blasio’s Aug. 13 vow that 400 be recruited, according to the agency.

“We are on track to fill our need by the first day, as promised,” Department of Education spokesman Nathaniel Styer said.

Stats show a different trajectory.

If hiring continues at the current rate of 63 new nurses a week, schools will still be 25 nurses short when kids return on Sept. 21.

De Blasio vowed last month that the city-run Health and Hospitals Corporation would be tasked with hiring the 400 nurses. There are 359 openings, but it is expected there will be more vacancies after accounting for medical exemptions.

The declaration came less than two weeks after the agency told The Post it had yet to establish a plan for filling the nursing gap — an issue New York City schools have been dealing with for years and parents are raising alarms about.

“So, to all the folks who have been raising that concern, I hear you loud and clear. And that will be in place. We have a whole month until school begins and we’re going to be ready to do great things for our kids,” de Blasio said on Aug. 13.

Organize and work together at your school level. The UFT has thrown you under the proverbial bus There is safety and strength in numbers.

DO NOT GO INTO THE BUILDING UNLESS ALL 50 ITEMS ON THE CHECK LIST ARE MET.
YOU NEED TO FIGHT THIS.
IF THE BUILDING IS NOT READY FOR THE STUDENTS, IT IS NOT READY FOR TEACHERS.

TEACHERS ARE KNOWN TO BE VERY GULLIBLE. DO NOT BE DISINGENUOUS.
IT IS YOUR HEALTH ANS SAFETY AS WELL AS THE SAFETY OF YOU FAMILIES THAT YOU ARE
RISKING.

NO NURSE, DO NOT GO INSIDE.
DO NOT TRUST YOUR PRINCIPAL OR APs. ASK FOR EVERYTHING IN WRITING.
THE DOE HAS LIED AGAIN AND AGAIN.
THIS IS THE RE-OPENING ULTIMATE DEGRADATION AND HUMILIATION.

RESIST THE TEMPTATION TO BE LULLED INTO A FALSE SENSE OF SECURITY.
NO VENTILATION REPORTS IN WRITING , DO NOT GO INSIDE.

DO NOT BE FOOLS! DO NOT ENTER THE SCHOOL BUILDINGS!

All you strikers who were willing to risk serious fines, calling people scabs, comparing scabs to child molesters..Can't pull together $500 for a lawyer... put up a go fund me... maybe the retirees who were encouraging you, will chip in a couple bucks.

What is the point of teachers commuting to schools next week to sit in separate classrooms all day and have online meetings that could be done SAFELY from home? There are no students in the buildings! Why make teachers come in and risk their health??

Anonymous said...

They want you earning your lousy pay. They think you would slack off if able to be home. They do not view you as the educated, responsible professional you are. That’s why.

Bryan Glass lost the class action suit brought on by the Absent Teacher Reserve a few years ago.

James Eterno said...

And Glass won the case for Francesco Portelos where there was a posting showing how DOE engaged in anti'union actions.

Someone should keep a list of the lies DeBlasio, Carranza, and the UFT have offered in order to force buildings open.

Jay said...

If there were to be an injunction do we think that would happen before the first day of school?

Many large high school buildings in the Bronx have the same problem - Evander Childs, Roosevelt, some floors in Columbus, Grace Dodge (the worst), some floors in Lehman Kennedy Walton, Smith, Morris, Taft, Herman Ritter Bldg. to name just a few.

I'm writing a book charting the lies...

So just to confirm, if one is not able to pay the $500 and be officially added, then one will not be able to opt for remote teaching if the case wins in court?

Anonymous said...

James, you sound dumb. We are in the uft, paying dues...But we should hire an outside lawyer?

Anonymous said...

They do not care if we live or die. We are replaceable. Hope no one we know dies.

9:15 pm,
Absolutely. I would be happily SURPRISED if the majority of educators followed through with your advice. Stay safe. If you see something, say something. Take pics. Record the crazy. Contact the media.

I’d be happy to. I’d prefer that than giving money to Mulgrew. Mulgrew visits Boca Raton, Florida several times a year asking retirees for money for COPE. Here’s a few of lines Boca Harry has told me Mulgrew has said over the years - ‘Charters are after us. Trump is after us. DeVos is after us. You need to support us or your pension could be taken away by the republicans. Give until it hurts, because you’re actually saving yourself.’ Harry has a tendency to exaggerate, but you get the idea. After squeezing dues from retirees all their lives, even after they’ve retired, he goes down there charges $50 for a meet and greet and pleads for money. And he gets it.

James Eterno said...

If the UFT leadership does not support us, members have to take matters into their own hands. It does not mean we still don't need a union. Lawyers charge money. See how much it will cost to retain one. Bryan is not trying to RIP people off.

The best solution of course is to get together and vote out Unity Caucus. I know I've said the UFT election is conducted on an unlevel playing field but after the leadership keeps sending the membership into unsafe buildings during a pandemic, maybe enough people have finally had enough of Mulgrew-Unity.

Sadly you're probably right. If only a majority of professionals had raged against the DOE'S churning out worthless diplomas or had taken action against the destruction of the discipline code, maybe the DOE would have been fearful of messing with educators. I think you're right. They do not view teachers as the educated responsible professionals they are. Lesson learned. Smh

waitingforsupport said...

9:50 am
Did you vote in the last election?

Anonymous said...

9:50 AM You should do what's best for you and yours. There are teachers that pay union dues and still hired Mr. Glass because they were doing what was best for them.

Anonymous said...

Sure did. Voted against unity. I was one of the few based on the outcome.

waitingforsupport said...

11:16
You said it...one of the few. Some didn't vote at all. Hopefully this wake up call will light the fire under the arce of the silent folks. However, calling anyone dumb because they believe in the union AND stepping out to join a lawsuit is uncalled for. It's a personal choice.

Send a message, don’t go in tomorrow. I’m not going in at all this week, I have hay fever, but fear it may be Covid. Fuck you, DeBlasio and Mulgrew; and the horse you rode in on, Randi.

What ever happened to the ATR case with the lawyer Bryan Glass?

James,

I heard indirectly that some blogs were posted as excellent resources, could I impose on you to list them from today's meeting. I'm confident that other supporters and posters on your blog will find it helpful as well. Thanks for your considering this request

I have a question regarding Tuesday. I am a PE teacher expecting to get a schedule but the admin has been vague about exactly what I am doing. I'm not trying to sound arrogant but I am one of those people who excelled at school and knows a lot about just about every subject especially since my 3 daughters are elementary/middle school aged and I work with them constantly so i am aware of what is going on in SS, Math, Science and English. I am not saying I would have the classroom management, lesson plans, and so on of these subjects perfected. However, I am knowledgable enough to do it in an emergency situation like this. Again, not trying to sound arrogant but it just happens to be true...and the admin is aware of this.

So my question is are we supposed to stay within our own license (PE for me) or could I be asked to teach a different subject? What are my rights? Expectations? Whatever help someone could give would be appreciated.

I can vouch for Glass. He beat the bottom feeders from my administration and the DOE in my Article 78 hearing.
Ineffective ruling was "vacated and annulled" due to the fact that my administration "undermined the integrity and fairness" of the observation process.

10:24: The judge threw out the ATR case saying just because you don't like where you work, doesn't mean you're being treated unfairly. Again, it was the same line, be lucky you have a job.
